Here, please find all terms and conditions related to any order placed with us. By working with NYC Film Lab, you agree to all terms and conditions that follow below.
All Orders
Liability
NYC Film Lab’s maximum liability for any order is for the value of the amount paid. A customer’s liability may be less, but is limited to $1,000: this is usually only applicable in the rare event that a customer gives us “film soup” without warning (film soup is experimental film that has been pre-exposed to other chemicals prior to exposure and/or development. Such film must always be processed separately), in which case we reserve the right to charge the customer up to the loss amount or $1,000, whichever is less.
Film photography and all aspects of it including processing and scanning are both a science and an art, and as such, these processes are not exact or always perfect. NYC Film Lab cannot guarantee any aspect of the film provided to us for processing, scanning, or printing. While we always do our best to provide superb results that have earned us great customer reviews, sometimes mistakes, mechanical/machinery breakdowns, customer errors, or unknown errors occur. We never recommend shooting a “mission-critical” project such as a final school project or commercial shoot on just one roll of film. Best practice would be to shoot multiple rolls and even place multiple orders across separate days for these rolls for any mission-critical work. Our liability is always limited to the customer-paid cost of service, while we may extend additional courtesies at our discretion.
Refunds
Most orders are non-refundable for any reason. Any amount paid for in-store or online is subject to a maximum refund of 95% (at our discretion) to cover processing and handling fees. Please inquire beforehand about pricing and availability if you require a refundable option beforehand for any reason. Any and all refund agreements are null and void unless in writing and signed by the owner or manager.
Print Order Agreement
By placing any print order, you agree to the following terms:
I have read all the information on the product page as well as the information pertaining to print services on the FAQ page. I understand my order is non-refundable, but that I may still receive future credits in certain situations. I understand any printed prints will not be credited or refunded and that quality is only guaranteed on the print quality and is specifically not guaranteed on the image quality for the images I provide to NYC Film Lab for printing. I understand that the "risk-free printing" and crediting process is a non-guaranteed courtesy and that its implementation is subjective and to the full and final discretion of NYC Film Lab and its team members. I understand sales tax must be added to local print orders and, if necessary, agree to pay the appropriate sum through an additional invoice if it is not properly charged for any reason upon checkout (note: sales tax is applicable for all local/NYC orders and is 8.88% as of 2022). I understand orders printed and not picked up (or without paid shipping and a shipping request) within 30 days of order completion may be discarded without further warning and that, in such cases, I will not be entitled to a refund or credit of any kind.
Shipping Agreement
Any order with shipping has natural risks. We cannot and do not guarantee any shipping service, and nor does any shipping carrier we may use. While we usually use FedEx, we reserve the right to change our carrier for any reason. Ship-by and receive-by dates are never guaranteed. Please plan ahead and accordingly.
Sensitive Work Liability Release
We understand customers trust us with their most sensitive work every day. Whether due to NDAs to protect corporate product announcements or sensitive fine art imagery, we know the need to keep certain works under tight wraps. As such, all our employees have signed NDAs to help protect your works. However, please note that depending on the service level selected, we do not always review images for sensitivity. For example, it’s possible we set focus and other scan parameters on some of the first images and do not notice sensitive images on later exposures on the same roll, regardless of how obvious the sensitive nature of the images may be. For this reason, guaranteeing sensitive work requires additional time, cost, and, most importantly, notice. Please let us know if your work requires special handling for any reason so we can take steps to ensure additional safeguards are in place. Without notice and prior additional agreements, we cannot and do not assume any lability for the release (accidental or otherwise) of any images processed by our lab or partners.
Gear Purchase
By purchasing gear through NYCFilmLab.com, you are agreeing to the following terms and conditions:
1.) All orders for pickup or with New York shipping addresses are charged sales tax. For those with shipping addresses in any other state or region, other taxes including but not limited to Use Tax, all of which may or may not be owed in other regions, are buyer's responsibility and are usually not automatically charged.
2.) Five (5) percent of the amount paid upon checkout today is non-refundable for any reason once paid. DO NOT CHECK OUT if this is not understood or if you still have questions about the item you are ordering and would like the option for a full refund, as this will NOT be possible. To reiterate, only 95% of the amount paid online will ever be refundable should you want to cancel your order (this does not include situations in which we may make mistakes that necessitate a return, in which case we may naturally refund up to the full amount paid).
3.) All cameras and lenses are guaranteed to work as described and come with a 7-day 100% refund guarantee. If an item is not as described, we will offer a full refund (including any and all associated fees). Exceptions include where visible damage has occurred. We document the bodies and serial numbers before shipping, so we know their exact conditions before they leave our hands. Any such claims for physical damage require immediate notice BEFORE they are signed for upon pickup from the mail carrier to ensure adequate time within their policies for us to file the appropriate claims. Failure to do so may result in our inability to compensate for damage of which we are notified at a later date. You MUST inspect the item before signing for its receipt, as this releases us from liability from shipping damage.
3.) All items are final sale. You understand this and have read and approved of everything in the camera, item, and/or service item description. Refunds will only be given in the event of a mistake on our end and at our discretion. If you have questions, please reach out to us before completing purchase.
4.) Consumable goods, including film, are non-refundable for any reason. No exceptions. and no warranties. All film is guaranteed to be genuine and stored as described prior to shipment.
5.) This is a summary of our terms and conditions as it relates to purchasing gear and some other goods. Checking out for any product indicates you agree to all terms on our site. For any discrepancies between the terms agreed to at checkout and those on this general terms and conditions page, the terms on this general terms and conditions page shall prevail.
